Pennsylvania DUI Law (75 Pa.C.S. 3802)

In Pennsylvania, a person is charged with DUI - driving under the influence of alcohol or controlled substances - when he or she drives, operates or in actual physical control of the movement of a vehicle after imbibing a sufficient amount of alcohol such that (1) the individual is rendered incapable of safely driving, operating or being in actual physical control of the movement of the vehicle, or (2) the alcohol concentration (BAC) in the person's blood or breath is at least .08%. 

You may also be charged under the PA DUI law if you drive, operate or are in actual physical control of the movement of a vehicle and you have consumed controlled substances.  The PA DUI law is set forth in the PA Motor Vehicle Code at 75 PA.C.S. § 3801, et. seq.  Learn more about the Pennsylvania DUI law.

Impairment (BAC) Levels for a PA DUI

The PA DUI law sets forth three types of impairment that will greatly affect your penalty if you are convicted of DUI.  The three types of impairment for a PA DUI are as follows:

  • General impairment:  BAC .08 - .099%
  • High:  BAC .10 - .159%
  • Highest:  BAC .16 and higher

Penalties for PA DUI

A DUI conviction in Montgomery County or elsewhere in Pennsylvania has serious consequences, including the suspension or revocation of your PA driver's license. 

The possible driver's license suspensions for DUI in PA are determined as follows:

  • BAC below .10% and incapable of safe driving:  no suspension of PA driver's license for your first offense if the you meet certain criteria; 12-month PA license suspension for your second or subsequent offense.
  • BAC greater than or equal to .10% and less than .16%:  12-month PA license suspension for your first and second offense. 18-month suspension for a third or subsequent offense.
  • BAC greater than or equal to .16%:  12-month PA license suspension for first offense. 18-month license suspension for your second or subsequent offense.
  • Out-of-state DUI convictions:  no license suspension for first offense; 12-month PA driver's license suspension for second or subsequent offense.
