divorce attorney montgomery county paBelow is an outline of the divorce procedures for Montgomery County, Pennsylvania under § 3301(c) of the Pennsylvania Divorce Code.  Section 3301(c) provides that parties may obtain a divorce through mutual consent. 

A Montgomery County divorce begins with the filing of a Complaint in Divorce.  The Divorce Complaint must be served upon the other spouse, and an Affidavit of Service or an Acceptance of Service must be filed within 30 days.  Then, after 90 days have elapsed and the parties have filed their consents to the divorce, the Court may grant a divorce decree.    

Parties to a divorce should always be represented by an attorney.  The procedure outlined above is a brief outline of the steps involved, and experienced counsel can help prepare and properly file all necessary documents to obtain the decree.  In addition, the divorce process can include difficult decisions regarding child custody, spousal support, payment of marital debts and equitable distribution of marital property.  An attorney can advise the client on his or her legal rights regarding these issues.  Often, the parties enter into a written marital settlement agreement for resolution of these issues prior to obtaining the divorce decree.  Again, this should be done with the assistance of an experienced attorney.
